Terms of Service
Thrive Growth Solutions (ashleyfrank.com). Last updated: November 1, 2026
1. Who we are and what these terms cover
These Terms of Service (“Terms”) are an agreement between you and Thrive Growth Solutions, a sole proprietorship owned by Ashley Frank (“Thrive Growth Solutions”, “we”, “us” or “our”), based in Halifax, Nova Scotia, Canada.
They apply when you:
- visit ashleyfrank.com or any page we run (the “Site”);
- download a free resource, such as The Follow-Up Formula guide, or join our email list;
- sign up for a free challenge, workshop or event, such as the Confident Closer challenge;
- buy or join a coaching or training program, including the Build Your Sales System group program and 1:1 coaching;
- book a workshop or training for your team; or
- subscribe to software we provide, such as SalesGuide.app (powered by HighLevel).
We call all of these the “Services”. By using the Site or the Services, or by checking a box or paying, you agree to these Terms. If you don’t agree, please don’t use the Services.
Some Services come with their own order form, proposal or agreement (for example, a team workshop proposal). If that document conflicts with these Terms, the specific document wins for that Service.
2. Who can use the Services
You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding agreement. If you sign up on behalf of a business, you confirm you’re authorized to bind that business to these Terms, and “you” includes that business.
3. Free resources, the email list and communications (CASL)
Free resources. When you request a free resource (such as a guide, checklist or quiz result), you give us your name and email address and agree that we can send you that resource plus related emails.
Your consent. Canada’s Anti-Spam Legislation (CASL) requires your consent before we send you commercial messages. When you sign up for a free resource, challenge or event, or buy from us, you agree to receive emails (and, where you’ve given us your number and agreed, text messages) from Thrive Growth Solutions about our content, programs, events and offers.
Unsubscribing. Every marketing email has an unsubscribe link. You can also email us at ash@ashleyfrank.com. We’ll process your request within 10 business days, as CASL requires. Unsubscribing from marketing doesn’t stop messages we need to send about something you bought (receipts, program logistics, account notices).
Sender identity. Our messages identify Thrive Growth Solutions and include our mailing address: 409-5415 Cogswell Street, Halifax, Nova Scotia B3J 0K8.
4. Free challenges and workshops
Free events. Our free challenges and live workshops (for example, the 3-day Confident Closer challenge) are free to join. We may change dates, times, format or content, or cancel an event. If we do, we’ll tell registered participants by email.
Offers during events. During free events we may present paid programs. You’re never required to buy anything to take part.
Recordings. Live sessions may be recorded, and recordings may be shared with participants who have access. If you turn on your camera, use your microphone or post in the chat, you agree that your name, image, voice and comments may appear in the recording. If you’d rather not appear, keep your camera and mic off and use the chat privately, or contact us. Group recordings are shared only within that group. We never use them in marketing or make them public without your written permission. 1:1 sessions are recorded only if you ask and give written permission.
5. Paid programs and coaching
What’s included. Each program’s sales page, checkout page, proposal or welcome email describes what’s included: the number of sessions, format, length, access period and any software. That description is part of your agreement with us.
Group programs. The Build Your Sales System group program runs in cohorts with set start dates. We may set a minimum and maximum number of seats. If we cancel a cohort before it starts, you can choose a full refund or a seat in a later cohort.
Beta cohorts. We may offer a “beta” cohort at a reduced price. Beta participants understand the program is still being refined, and content, schedule and format may change during the cohort. We’ll ask beta participants for honest feedback and, if they’re happy to give one, a testimonial. A testimonial is never a condition of joining.
1:1 coaching. Sessions are booked through our scheduling link. Please reschedule at least 24 hours before your session. If you miss a session without notice, or cancel with less than 24 hours’ notice, that session may be counted as used. Unused sessions expire at the end of your program term.
Team workshops and training. Workshops and training for organizations (such as Leading Customer Conversations) are covered by a separate proposal or agreement that sets out scope, fees, dates, cancellation and rescheduling.
Changes and substitutions. We may update program content, tools or session times to improve the program, as long as the overall value of what you bought isn’t reduced.
6. Payment
Prices and taxes. Prices are in Canadian dollars (CAD). HST and other applicable sales taxes are added where required. HST registration number: 806728945.
How you pay. Payments are processed securely by Stripe. We don’t store your full card details.
Payment plans. If we offer a payment plan and you choose it, you authorize us to charge your payment method on the schedule shown at checkout. A payment plan is a way to pay the full program price over time. It isn’t a monthly subscription you can cancel partway through. If a payment fails, we’ll let you know and may pause your access until it’s resolved.
Chargebacks. If you have a billing problem, please contact us first at ash@ashleyfrank.com, and we’ll work to fix it. If you dispute a valid charge with your bank instead, we may suspend your access while the dispute is open.
7. Refunds and cancellations
30-day guarantee (Build Your Sales System only). The Build Your Sales System program comes with a 30-day money-back guarantee. If you’re not satisfied, send us a written refund request by email to ash@ashleyfrank.com within 30 days of your purchase date, and we’ll refund what you paid for the program. Verbal requests, or requests made in a group call or chat, don’t count. Please put it in writing so we have a clear record. After 30 days, payments are non-refundable.
If you’re on a payment plan and request a refund within the 30 days, we’ll refund the payments you’ve made and cancel any remaining payments.
Everything else is non-refundable. The guarantee doesn’t apply to any other purchase, including other coaching or programs and SalesGuide.app subscription fees (see section 8 for how to cancel a subscription). The only exceptions are:
- Team workshops. As set out in your proposal or agreement.
- If we cancel. If we cancel something you paid for and don’t offer an acceptable alternative, you get a full refund, whenever that happens.
Nothing in this section limits any refund or cancellation rights you have under the laws of your province, including Nova Scotia’s Consumer Protection Act, which may apply to purchases made online by consumers.
We process approved refunds to your original payment method within 10 business days.
8. SalesGuide.app software (powered by HighLevel)
What it is. SalesGuide.app is a white-labelled version of the HighLevel platform, which we resell and set up for clients. HighLevel, Inc. owns and runs the underlying software. Plans start at $97/month plus applicable taxes. Current plans and pricing are shown at signup.
Included with programs. Some programs include SalesGuide.app access for the program period. Before the program ends, we’ll explain your options by email. If you’d like to keep using it, you can choose to continue on a paid plan (plans start at $97/month plus tax). Nothing is charged unless you choose to continue.
Subscriptions. Subscriptions renew automatically each month until you cancel. You can cancel anytime by emailing ash@ashleyfrank.com. Cancellation takes effect at the end of the current billing period. We don’t give partial-month refunds.
HighLevel’s terms also apply. By using SalesGuide.app, you also agree to HighLevel’s terms of service and acceptable use rules, which apply to the platform. We aren’t responsible for outages, data loss, feature changes or price changes made by HighLevel. If HighLevel raises its prices or changes features, we may change your subscription price with 30 days’ notice.
Your data and your responsibilities. You own the contacts and content you put into SalesGuide.app. You’re responsible for having the right to use that data and for following the law when you message your own contacts, including CASL, the CRTC’s rules on texting and calling, and privacy laws. Don’t use SalesGuide.app to send spam or anything unlawful. We may suspend an account that does.
Setup work. Setup, automations and templates we build for you are provided as described in your program or proposal. After your program ends, any further changes are billed separately unless we agree otherwise.
If you leave. Before you cancel, you can ask us to help you export your contacts. After cancellation, your account stays available for 30 days so you can export your data. After that, it may be permanently deleted.
9. Coaching is not professional advice, and results aren’t guaranteed
Coaching, not therapy or professional advice. Our Services are business coaching and sales training. They aren’t legal, financial, tax, accounting, investment, medical or mental-health advice, and they aren’t a substitute for advice from a licensed professional. You’re responsible for your own decisions and their results.
No guaranteed results. Any examples, testimonials, case studies or figures we share (including revenue, close rates or lead costs) are examples of what particular people achieved. They aren’t typical or promised. Your results depend on your effort, your market, your offer and many other things we don’t control. We don’t guarantee any particular income, sales or business outcome.
Coaching standards. Ashley Frank is a member of the International Coaching Federation (ICF) and follows the ICF Code of Ethics in coaching work.
10. Your conduct
When you use the Services, including group calls, community spaces and chats, you agree to:
- treat other participants and our team with respect (no harassment, discrimination or abusive language);
- keep what other participants share in group sessions confidential;
- not sell, promote or recruit other participants without permission;
- not record sessions yourself unless we say you can; and
- not use the Services for anything unlawful.
We may remove anyone from a program or community who breaks these rules. If you’re removed for serious or repeated breaches, you won’t get a refund.
11. Intellectual property
Our materials. Everything we create and provide, including the Site, guides (such as The Follow-Up Formula), worksheets, templates, frameworks, scripts, slides, videos, recordings, email sequences and SalesGuide.app templates, belongs to Thrive Growth Solutions or its licensors and is protected by copyright and other laws.
Your licence. When you get our materials, free or paid, you receive a personal, non-transferable licence to use them for your own business. You may adapt templates and scripts for your own use with your own clients and prospects.
What you can’t do. You may not resell, share, publish or redistribute our materials; share your login or program access with others; use our materials to run your own competing course, coaching or training program; or remove our copyright notices. Team workshop materials may be used inside the client organization as set out in the proposal.
Your content. You keep ownership of what you share with us (your business information, work you submit, posts). You give us permission to use it to deliver the Services to you. We won’t share your business information publicly without your permission.
Testimonials and feedback. If you give us a testimonial, you agree we can use it, along with your name and business name, in our marketing. We’ll only use your photo with your permission. You can ask us to stop using it in new materials at any time. We may use any suggestions or feedback you give us to improve our Services, with no obligation to you.
12. Privacy
We collect and use personal information as described in our Privacy Policy at https://ashleyfrank.com/privacy. In short, we use your information to deliver the Services, communicate with you and improve what we offer. We use tools such as HighLevel/SalesGuide.app, Meta (Facebook/Instagram) advertising and lead forms, Zoom and payment processors, which may store data outside Canada.
13. Third-party services and links
The Site and Services may link to or use third-party services (for example, Zoom, Meta, HighLevel, payment processors and scheduling tools). We aren’t responsible for those services, and your use of them is subject to their terms.
14. Disclaimers
To the extent the law allows, the Site and Services are provided “as is” and “as available”. We don’t promise the Site or any software will be uninterrupted or error-free. Some laws don’t allow certain warranties to be excluded, so some of this section may not apply to you.
15. Limitation of liability
To the extent the law allows:
- we aren’t liable for indirect, incidental, special or consequential losses, including lost profits, lost revenue, lost data or lost business opportunities; and
- our total liability to you for any claim related to the Services is limited to the amount you paid us for the specific Service in question during the 12 months before the claim arose.
Nothing in these Terms limits liability that can’t be limited by law, or rights you have as a consumer under applicable law.
16. Indemnity
If you’re using the Services for a business, you agree to cover our reasonable losses and costs (including legal fees) if a third party makes a claim against us because of your breach of these Terms, your misuse of the Services, or messages you send to your own contacts using SalesGuide.app.
17. Changes to the Services or these Terms
We may update these Terms from time to time. We’ll post the updated version on the Site with a new “Last updated” date, and for material changes we’ll notify active clients by email. Changes don’t apply retroactively to a program you’ve already paid for, unless you agree.
18. Ending your use of the Services
You can stop using the Services at any time, subject to the refund and subscription rules above. We may suspend or end your access if you breach these Terms. Sections that by their nature should survive (such as payment owed, intellectual property, disclaimers, limitation of liability and governing law) continue after your access ends.
19. Governing law and disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there. If there’s a dispute, please contact us first. We’ll try to resolve it informally within 30 days. If we can’t, you and we agree to the jurisdiction of the courts of Nova Scotia, except where consumer protection law gives you the right to bring a claim where you live.
20. General
- Whole agreement. These Terms, together with any program description, order form or proposal, are the whole agreement between you and us about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce a term right away, we can still enforce it later.
- Assignment. You can’t transfer your rights under these Terms without our written consent. We may transfer ours as part of a sale or reorganization of the business.
- Events outside our control. We aren’t responsible for delays or failures caused by events beyond our reasonable control (such as outages, illness or severe weather). If that happens, we’ll reschedule or offer a fair alternative.
- Language. These Terms are written in English, and the parties agree they are to be in English.
